These Terms of Service ("Terms") govern your access to and use of The Daily Stitch website and Services. The Daily Stitch is operated by Tohana Global LLC ("The Daily Stitch," "we," "us," or "our"). By visiting the website, purchasing a product, or using any part of the Services, you agree to these Terms and our posted policies.

1. ELIGIBILITY AND ACCEPTANCE

You must be legally capable of entering into a binding agreement in your jurisdiction. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

2. OUR DIGITAL PRODUCTS

We sell digital crochet patterns, PDF files, tutorials, printable materials, downloadable guides, and related digital content. Product photographs may show an example of a completed project. Unless a listing expressly states otherwise, your purchase is for a digital file only; no finished item, yarn, hook, tool, or physical product will be shipped.

Please review the product description, language, crochet terminology, skill level, materials, file format, and device requirements before purchasing.

3. DIGITAL DELIVERY

Digital products are normally delivered through a download link displayed after checkout, sent by email, or made available through an account or delivery service. Delivery may be delayed by payment review, an incorrect email address, spam filtering, service interruptions, or technical issues. Contact us if you have not received access within 15 minutes after payment is confirmed.

4. LICENSE AND PERMITTED USE

When you purchase a digital product, you receive a limited, non-exclusive, non-transferable, revocable license to download and use the product for your personal crochet and crafting purposes, subject to these Terms and any additional terms stated in the product listing.

Unless a product listing states otherwise, you may sell a limited number of physical finished items that you personally make using the pattern. You may not use factories, mass production, or automated production. You may not imply that you designed the pattern.

5. PROHIBITED USE OF DIGITAL CONTENT

You may not, in whole or in part:

  • copy, reproduce, translate, modify, adapt, distribute, publish, upload, share, exchange, sublicense, rent, or resell the digital files or pattern instructions;

  • provide the files through social media, messaging groups, cloud drives, file-sharing sites, classes, memberships, bundles, marketplaces, or print-on-demand services;

  • convert the files into another format for redistribution;

  • use our photographs, graphics, branding, listings, or text to market your products without written permission;

  • claim authorship or ownership of our digital content; or

  • use the content to create a competing pattern, pattern database, training dataset, or commercial digital product.

Purchasing a file does not transfer copyright or other intellectual property rights to you.

6. CROCHET RESULTS AND SAFETY

Finished results may vary due to yarn, hook size, tension, substitutions, skill level, device display, printing, and interpretation. You are responsible for choosing suitable materials, checking measurements and gauge, and using tools safely.

Finished items containing small parts, safety eyes, cords, buttons, beads, stuffing, or other components may not be suitable for young children or pets. You are responsible for testing and labeling any finished item you make or sell and for complying with applicable product-safety laws.

7. PRICES, PAYMENTS, AND TAXES

Prices, discounts, and availability may change without notice. The price displayed at checkout controls unless there is an obvious error. You agree to provide current, complete, and accurate billing information. Taxes may be charged where required by law.

We may correct pricing or description errors, reject or cancel an order, limit quantities, or request additional verification. If we cancel a paid order, we will refund the amount charged for the canceled item.

8. PROMOTIONS AND DISCOUNT CODES

Promotions may be subject to separate terms, expiration dates, eligibility limits, and product exclusions. Unless stated otherwise, discounts cannot be combined, exchanged for cash, or applied retroactively.

9. REFUNDS

Refunds and problem resolution are governed by our Return and Refund Policy. Nothing in these Terms limits a mandatory consumer right that cannot legally be waived.

10. ACCOUNTS AND SECURITY

If account features are available, you are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.

11. REVIEWS, FEEDBACK, AND USER CONTENT

If you submit a review, photograph, comment, suggestion, or other content, you confirm that you have the right to submit it and that it is not unlawful, misleading, infringing, or harmful. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and share that content in connection with operating and promoting the Services, subject to applicable law and our Privacy Policy.

We may moderate or remove user content, but we are not obligated to do so.

12. THIRD-PARTY SERVICES AND LINKS

The Services may rely on or link to Shopify and other third-party services. We are not responsible for third-party websites, content, availability, policies, or practices. Your use of third-party services may be subject to separate terms.

13. PROHIBITED CONDUCT

You may not use the Services to violate law, infringe rights, distribute malicious code, interfere with security, scrape or overload the website, impersonate another person, commit fraud, or engage in abusive or deceptive activity.

14. INTELLECTUAL PROPERTY

The Services and their content—including patterns, instructions, photographs, illustrations, graphics, logos, branding, text, and website materials—are owned by or licensed to Tohana Global LLC and are protected by applicable intellectual property laws. Except for the limited license expressly granted above, no rights are transferred to you.

15. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, the Services and digital products are provided "as is" and "as available." We do not guarantee uninterrupted access, error-free files, or that a finished project will exactly match photographs. Some jurisdictions do not allow certain warranty exclusions, so these exclusions may not fully apply to you.

16. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Tohana Global LLC and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from the Services or digital products.

To the maximum extent permitted by law, our total liability for a claim relating to a purchase will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be excluded.

17. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Tohana Global LLC from third-party claims, losses, and expenses arising from your unlawful use of the Services, violation of these Terms, infringement of another person's rights, or sale of physical finished items made using our patterns.

18. GOVERNING LAW

These Terms are governed by the laws of the State of Montana and applicable federal law, without regard to conflict-of-law principles. Mandatory consumer protections available to you under applicable law remain unaffected.

19. SEVERABILITY AND WAIVER

If any provision is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

20. CHANGES TO THESE TERMS

We may update these Terms by posting a revised version with a new "Last updated" date. Changes apply prospectively unless otherwise stated or required by law. Continued use of the Services after an update constitutes acceptance where permitted by law.
